Terms and Conditions of Sale

These Terms and Conditions govern the sale of services offered on the website cosplaymood.com and regulate the relationship between the Supplier and Users who make purchases through the platform. Submitting an order implies full acceptance of these conditions, which define the rights and obligations of both parties regarding the methods of purchase, payment, delivery, right of withdrawal, and product warranty.

The Supplier reserves the right to modify these Terms and Conditions, as well as the Privacy Policy, at any time to adapt them to new operational, regulatory, or commercial needs. Any changes will be notified to Users via a specific notice published on the Site and may, at the Supplier's discretion, also be communicated via email.

The changes will be effective from the date of their publication and will apply exclusively to orders placed after that date. The online sale of Services on the Site is governed by current legislation on electronic commerce, particularly the Consumer Code (Legislative Decree No. 206/2005) and the Electronic Commerce Code (Legislative Decree No. 70/2003), which regulate digital transactions and ensure consumer protection in online purchases.

ART. 1 DEFINITIONS
For the purposes of this contract, the terms indicated below will have the meaning attributed to them in the following definitions:

General Terms and Conditions: these contractual clauses governing the relationship between the Supplier and the Customer concerning the Products offered.
Website: cosplaymood.com
Products: the sale of cosplay costumes, armors, accessories, wigs, shoes, personalized merchandise, custom-made home decor, and any other product offered by the Supplier, by way of example and not limitation.

Purchase: the paid acquisition of the Products described above by the Customer, with the conclusion of the contract at the time of order confirmation.
Order: the purchase proposal made by the User through the checkout procedures of the Site, including product selection and payment via the Cart.

Customer: anyone who purchases the Products sold through the Site.
Consumer: a natural person who purchases the Products for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activity.
Professional: a natural or legal person who purchases the Products in the exercise of their entrepreneurial, commercial, artisanal, or professional activity.
User: anyone who accesses the Site, regardless of whether they make a purchase.

ART. 2 PURPOSE
These Terms and Conditions govern the sale of the products listed in Art. 3 and regulate the relationship between the Supplier and any User who makes a purchase on the Site, either as a Consumer under current legislation or as a Professional. Acceptance of these Terms and Conditions is essential to make purchases on the Site.

If one or more clauses are null or ineffective for any reason, this will not affect the validity and effectiveness of the remaining provisions, which will remain fully applicable between the Parties.

ART. 3 PRODUCT DESCRIPTION
The Site is engaged in the retail sale, under electronic commerce, of cosplay costumes, armors, accessories, wigs, shoes, personalized merchandise, and home decor, both standard and custom-made.

The Seller provides assistance for size selection after purchase, contacting the Customer via email or WhatsApp to ensure optimal fit. Products are available in two distinct versions: Essential and Deluxe.

The Essential version includes products made with good quality fabrics and materials, selected directly by the Seller without customization options by the Customer. All products listed on the Site, including future ones, fall into this category unless otherwise specified. The Seller commits to creating them as faithfully as possible to the images and descriptions in the product sheet.

The Deluxe version is a premium product offering the Customer the possibility to customize the costume by selecting materials, fabrics, color shades, and dimensions of specific elements, such as the length of a jacket, the size of a bag, or proportions of a prop weapon. Customization options are limited to those proposed by the Seller.

The Deluxe version is not available directly on the Site but can be requested through a personalized quote. If the quote is accepted, the Seller will create a dedicated link on the Site to allow order confirmation.

For the Deluxe version, the Customer expressly agrees that the product will be made according to the specifications provided by them, and any dissatisfaction related to choices made by the Customer will not be a valid reason for complaints. In particular, complaints will not be accepted regarding:
- the type of fabric selected
- the chosen color shade
- the measurements provided by the Customer (e.g., if a jacket is shorter than expected or a bag is smaller than desired).

The Seller will strictly follow the Customer's instructions, summarizing them in a PDF document to be shared before production, constituting a binding reference for both parties. All products are described and illustrated on the Site in their respective sections. Product images are purely demonstrative and illustrative and, despite the Seller's effort to represent them as accurately as possible, may present slight differences from the actual product.

Photos are not contractual elements, and no complaints will be accepted if the final product is not identical to the reference image, except in case of significant and objective differences. Given the artisanal nature of production, the Customer accepts slight differences between the finished product and the original model. Elements such as slightly different buttons, minor decorative variations, or adjustments necessary to transform a 2D illustration (cartoons, video games, comics) into a real product will not be grounds for complaints.

For customized or tailor-made products, the Seller does not guarantee perfect correspondence between the color and/or Pantone requested by the Customer and that printed on the final product. The User expressly accepts that minimal qualitative differences may occur compared to the graphic draft viewed on the Site, with a 10% tolerance margin.

If this margin is exceeded, the Seller will, at the Customer’s choice, refund the product price or apply a discount on the total amount. For all products sold through the Site, the Seller declines all responsibility for improper use of the product by the Customer. For third-party packaged products, responsibility for quality, safety, and accuracy of the information on the packaging lies with the manufacturer.

ART. 4 MYSTERY BOX
The Seller offers packages called "Mystery Box" for sale, containing a selection of products chosen by the Seller in standard sizes. Each Mystery Box will include various items, which may consist of, for example, a costume, an accessory set, merchandise items, or a bundle with multiple products. The total commercial value of the products in the Mystery Box will be clearly indicated before purchase, specifying a range (e.g., €100 to €250).

However, the price paid by the Customer will be lower than the declared minimum value of the Mystery Box (e.g., the Customer may purchase a Mystery Box for €90, even though it contains products worth at least €100 and up to €250).

To offer greater transparency, the Seller will provide an indicative list of possible products included in the Mystery Box, e.g.: inside you may find a costume, plus other merchandise.

However, the Customer cannot choose specific products, as the selection is at the Seller's discretion and follows the Mystery Box concept. Mystery Boxes represent a favorable purchase opportunity for the Customer and allow the Seller to reuse new products previously used for creating videos or promotional content, which were not subsequently sold due to logistical issues, size availability, or market demand.

All products included in the Mystery Box are new and never used for purposes other than simple display or demo recordings. However, due to the nature of the Mystery Box, once received, the Customer cannot request replacements, changes, or returns, except in case of non-conformity under current law.

ART. 5 HAKUNA MATATA WARRANTY
In case the Seller makes an error in the realization of the purchased product, such as sending a wrong size, a color different from the selected one, or any other discrepancy from the agreed specifications, the Seller commits to replacing the product free of charge with one that complies with the original order.

The replacement will be made at no additional cost to the Customer, provided that the error is attributable to the Seller. In such cases, the Customer must report the problem within 24 hours of receiving the product, providing photographic evidence of the detected discrepancy.

The following are not covered by this warranty:
- incorrect size communication by the Customer;
- change of mind after receiving the product;
- minimal color shade differences compared to the images on the Site, within the tolerance limits set out in Art. 3.

ART. 6 PRICES, ADDITIONAL CHARGES, AND DUTIES
The prices of the Products are shown in euros. In particular, the cart will detail:
- the price of the Product;
- delivery costs.
The Seller undertakes to constantly verify that all prices indicated on the Site are correct, without this guaranteeing the absence of errors. Should a pricing error be detected, the Seller will allow the Customer to purchase the product at the correct price or cancel the order.

Online shop prices may vary. In such cases, the prices published at the time of the Order on the online store apply. In the event of an error (computer, manual, technical, or other) causing a substantial and unforeseeable price change, making it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled, and the amount paid will be refunded within 14 days from the cancellation date, with prior notice to the Customer.

The Seller reserves the right to verify and evaluate the Customer's correctness and good faith, especially in the use of promotions or discount coupons. If the Customer's conduct is deemed unlawful or improper, the Seller will promptly notify and cancel the purchase order.

Depending on the place of delivery, the Products purchased may be subject to import taxes and/or customs duties, the amount of which may vary depending on the destination country.

It is impossible to predict whether and which costs will be incurred for customs clearance. Therefore, any import taxes and/or customs duties will be exclusively borne by the Customer. In the case of exports to non-EU countries, customs duties are the responsibility of the Customer. Customs duties vary depending on the destination country.

The Customer is obliged to inquire about the relevant regulations and bears the related responsibility. Customs duties are not considered shipping costs and are therefore borne by the Customer.

ART. 7 REGISTRATION
To make purchases on the Site, Users may register by entering their personal data. Users who wish to register must provide all requested data and are responsible for their accuracy and correctness.

Upon registration, Users guarantee that they:
- meet the registration requirements at the time of registration;
- comply with all applicable laws and contractual terms;
- are the legitimate owners of the provided data, which must be true, correct, and updated. Registration results in the creation of an account. At registration, Users will be asked to provide their name, email, and a password. The provided email allows the Seller to notify Users of all messages related to Services, Products, and the Site. Temporary emails are prohibited for registration.

In case of abuse, the Seller reserves the right to reject or revoke registration and report to the competent Authorities.

All transmitted data will be treated in full compliance with privacy regulations. The Seller will use them to fulfill orders and, only with explicit consent, to provide information about promotions or discounts.

ART. 8 PURCHASE PROCEDURE AND CONCLUSION OF SALE
The User can purchase all Products listed on the Site as described in their respective information sheets, following the purchase procedures provided. At the time of purchase, the Customer must follow all instructions on the appropriate Site page.

The Customer must place the desired Product in the "Cart" and, after reviewing the Terms and Conditions, especially regarding delivery costs, withdrawal methods, and Privacy Policy, choose the payment method and proceed with payment.

The applicable Terms and Conditions are those in force at the time of the Order and available on the Site. The contract between the Seller and the Customer is concluded upon acceptance of the Order by the Seller.

The Seller will notify the Customer of the acceptance via email to the address provided. The Seller may evaluate and reject orders that are incomplete, incorrect, for unavailable Products, or with delivery in restricted areas. The Seller will inform the Customer of any inability to accept the Order promptly and refund any amounts paid. The Customer waives any claim for compensation or damages related to non-acceptance, even partial, of an Order.

ART. 9 PAYMENT METHODS
The Customer can pay for orders using one of the following methods available on the Site: Bank transfer, Postepay, PayPal, Shopify Payments, Klarna, Hey Light. Payment must be made at the time of the order unless otherwise specified for specific installment payment methods where available.

The Customer acknowledges and accepts that the Seller cannot be held responsible for any delays or non-delivery of products if the issuing entity of the credit card, the selected payment method manager, or any other financial intermediary refuses or does not authorize the transaction for any reason.

In case of bank transfer payment, the order will only be processed after the actual crediting of the amount to the Seller's account. To speed up the order processing, the Customer is invited to send proof of the transfer via email to cosplaymood@gmail.com.

ART. 10 SHIPPING TIMES AND PRODUCT DELIVERY
All orders are processed and shipped on working days, Monday to Friday, excluding public holidays and national holidays. Orders placed on Saturday and Sunday will be processed starting from the next business day. For each order placed on the Site, the Seller issues a regular receipt of the shipped goods.

Order processing takes approximately 24/48 hours unless otherwise indicated. During this period, the Customer has the right to cancel the order and receive a full refund.

The production times of the product may vary depending on the type of item purchased and are specified on the product sheet on the Site. If delays or issues affecting production occur, the Customer will be promptly informed. For fully customized products, the Seller will provide a detailed estimate with production times via WhatsApp or email.

The Seller is not responsible for delivery delays due to unforeseen circumstances or force majeure, but will do everything possible to respect the indicated times.

Delivery is made via specialized express couriers, Monday to Friday, excluding holidays.

Estimated delivery times:
- Italy: within 24/48 working hours (up to 72 hours for islands and remote areas).
- European Union: approximately 5-8 working days from shipping.
- Non-EU: approximately 20-28 working days.
Delivery times are indicative and not binding.

The Customer will receive an email with a tracking number to monitor the shipment.

ART. 11 CUSTOMER'S OBLIGATIONS UPON DELIVERY
The Customer agrees to ensure their presence or a delegate upon delivery. The Customer must check the package's integrity and correspondence to the order. If damaged, the Customer must sign “ACCEPTED WITH RESERVATION BECAUSE DAMAGED”. Failing this, no refund or replacement will be possible.

In case of issues:
- Take photos of the damaged package/product.
- Contact the Seller at cosplaymood@gmail.com or WhatsApp, with images and description.
If compliant with conditions, the Seller will organize free replacement and pickup of the damaged product.

ART. 12 RIGHT OF WITHDRAWAL
Consumers, as per Italian Consumer Code (Art. 52 and following), can withdraw within 14 working days from delivery without justification. Notice must be emailed to info@cosplaymood.com, and the product must be returned within the same period, at the Customer's expense. Products must be intact, in original packaging, with all accessories and documents.

The refund will be issued within 14 days after checking the returned product. Return shipping costs are borne by the Customer. Used, personalized, or opened sealed products are not eligible for return. The right of withdrawal does not apply to Professional Clients (with VAT).

ART. 13 LEGAL WARRANTY
The Consumer Customer is entitled to a 24-month legal warranty under Legislative Decree No. 206/2005 and its subsequent amendments. If the Customer receives Products that do not conform to the order or are defective, they must notify the Seller via email, including photographic evidence and relevant details. In order to benefit from the warranty, proof of purchase must be presented.

In case of non-conformity of the goods, the consumer is entitled to:

  • restoration of the conformity of the goods,
  • a proportional reduction of the price,
  • termination of the contract.

For the purpose of restoring conformity, the consumer may choose between repair or replacement, provided that the chosen remedy is not impossible or excessively burdensome for the seller, considering:

  • the value the goods would have if there were no defect,
  • the extent of the defect,
  • the possibility of applying an alternative remedy without significant inconvenience to the consumer.

The consumer has the right to a proportional reduction of the price or to terminate the contract if:

  • the seller has failed to repair or replace the product;
  • a defect of conformity appears even after an attempt to restore conformity;
  • the defect is so serious as to justify an immediate price reduction or contract termination;
  • the seller has declared or it is evident that they will not restore conformity within a reasonable period.

The consumer is not entitled to terminate the contract if the defect is minor, and the seller is responsible for proving this.

The consumer has the right to a reduction of the price proportional to the decrease in value of the goods. In case of termination of the contract, this is exercised by means of a written notice to the seller. If the non-conformity concerns only some of the goods delivered, the contract may be terminated only for those goods.

In case of termination:

  • the consumer must return the product to the seller at the seller's expense;
  • the seller must refund the price paid for the product upon receipt of the product or of proof provided by the consumer that it has been returned or shipped.

If the Customer is a Professional, they are not entitled to the legal warranty of conformity, but only to the warranty provided by the Civil Code, meaning that in case of defects that make the Products unsuitable for their intended use or significantly reduce their value, they may request a price reduction or termination of the sale as provided by law. In this case, the defect must be reported to the Seller within 8 (eight) days from its discovery and in any case within 1 (one) year from delivery.

ART. 14 COMPLIANCE WITH GPRS AND PRODUCT INFORMATION
The Seller guarantees that the products sold on the Site comply with Regulation (EU) 2023/988 on general product safety (GPRS), ensuring that all items meet European safety standards.

To ensure transparency and consumer protection, each product for sale is accompanied by a detailed information sheet, available on the Site, including:

  • Materials used
  • Washing and maintenance instructions
  • Any usage warnings

Additionally, each package will include an informative leaflet with a QR code directing to a dedicated page on the Site, where Customers can find all technical details of the purchased product, in compliance with GPRS requirements on product information and traceability.

ART. 15 INTELLECTUAL AND INDUSTRIAL PROPERTY
The Site (including its content, graphics, source code, and any element contained therein), the Cosplaymood trademark, the domain name, related subdomains, and all related intellectual and industrial property rights are the exclusive property of the Seller. These rights are reserved and shall never be transferred or licensed to Customers or third parties.

The User or Customer may not reproduce, duplicate, copy, redistribute, retransmit to other websites, transfer, or make available to third parties any content from the Site without express and formal written authorization from the Seller.

Any names, logos, images, or references to third-party registered trademarks, including characters from cartoons, movies, video games, and comics, are used for descriptive and informational purposes only. These references are solely intended to represent the costume or inspiration behind the products sold and do not imply any partnership, affiliation, license, or official endorsement by the rightful owners. All trademarks, logos, and registered names mentioned remain the property of their respective owners.

ART. 16 FAILURE TO EXERCISE A RIGHT
The failure to exercise a right by the Seller does not constitute any waiver to act against the Customer or third parties for breaches of commitments undertaken. The Seller therefore reserves the right to assert its rights in any case, within the granted terms. Should any of these provisions become null or ineffective under applicable law, such nullity or ineffectiveness shall not affect the validity of the remaining provisions, which shall therefore remain fully effective and enforceable.

ART. 17 PERSONAL DATA PROCESSING (PRIVACY)
Personal Data provided or acquired will be subject to Processing based on principles of fairness, lawfulness, transparency, and protection of confidentiality in accordance with current regulations. The Seller, as Data Controller, processes Users' Personal Data by adopting appropriate security measures to prevent unauthorized access, disclosure, modification, or destruction of Personal Data. Processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the purposes indicated.

User Data is collected for the execution of pre-contractual measures; to fulfill obligations arising from the contract; for registration procedures aimed at purchasing Products; to respond to specific requests made by the User to the Data Controller; to send information and promotional offers, also via newsletter, based on the User's freely given consent; for soft spam purposes regarding promotional communications of purchased Products without the need for prior consent, as provided by art. 130, paragraph 4, of the Privacy Code as amended by Legislative Decree no. 101 of 2018.

Customers are therefore invited to carefully read the personal data processing notice (Privacy Policy) provided under EU Regulation 679/2016, as well as the Cookie Policy regarding the use of cookies with the related consent when required.

ART. 18 APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are entirely governed by Italian law.
Any disputes arising in relation to the validity, interpretation, execution, and termination of online contracts between the Consumer Customer and the Seller shall be under the exclusive jurisdiction of the court of the Consumer's place of residence (so-called consumer forum). Any disputes arising in relation to the validity, interpretation, execution, and termination of online contracts between the Professional Customer and the Seller shall be under the exclusive jurisdiction of the Court of Prato.

ART. 19 DISPUTE RESOLUTION
Pursuant to article 49 paragraph 1 letter V of Legislative Decree no. 206/2005 (Consumer Code), the Consumer Customer may make use of the Joint Conciliation procedure (ADR). According to art. 14 of Regulation 524/2013, in case of dispute, the Consumer Customer may submit a complaint via the EU ODR platform http://ec.europa.eu/consumers/odr/. SPECIFIC ACCEPTANCE OF UNFAIR CLAUSES
Pursuant to articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have read, understood, and expressly accepted by means of the checkbox on the website cosplaymood.com the following unfair clauses:
Art. 10 - Shipping and Delivery Times (Exclusion of Seller's liability for delays not due to its fault)
Art. 11 - Customer's Obligations at Delivery (Customer's obligation to sign with reservation in case of damaged package, under penalty of loss of refund right)
Art. 12 - Right of Withdrawal (Exclusion of right of withdrawal for customized products and Professionals, shipping costs and transport risks borne by the Customer)
Art. 13 - Legal Warranty (Limitations on warranty for Professionals, obligation to report defect within 8 days)
Art. 16 - Failure to Exercise a Right (No waiver of Seller's rights)
Art. 18 - Applicable Law and Jurisdiction (Exclusive jurisdiction of Prato for Professionals)
